St. George Bankruptcy Attorney

St. George is one of the fastest-growing cities in the United States, and that growth brings financial pressure as well as opportunity. Lincoln Law serves St. George and all of Washington County by virtual consultation — video or phone — so you can speak with a licensed Utah bankruptcy attorney without the four-plus-hour drive to our Orem office. Your consultation is free and confidential. Call 800-404-0018 to get started.

Washington County and the Cost of Growth

Washington County’s population has grown dramatically over the past decade as retirees, remote workers, and young families have discovered its scenery and climate. Rising property values and housing costs have followed. For residents who moved to St. George or Ivins on a fixed income, or who stretched their budget to buy a home during the boom, a sudden medical expense or job loss can tip the balance quickly.

Federal bankruptcy law offers a legal path out. Our attorneys have helped Utah residents across the state — from the Wasatch Front to the Dixie corridor — understand their options and find a fresh start.

Virtual Service for Southern Utah

Because Lincoln Law has no southern Utah office, virtual consultations are how we serve St. George, Santa Clara, Ivins, Washington City, Hurricane, and the surrounding communities. You meet with your attorney by video or phone at a time that works for you. Call 800-404-0018 to schedule a free consultation.

If you need to mail documents or drop off paperwork, our Orem office (921 West Center St., Orem, UT 84057) accepts deliveries. No office visit is required to file your case or attend your hearing.

Your Bankruptcy Court

St. George and Washington County cases are filed in the United States Bankruptcy Court for the District of Utah. Utah has one federal bankruptcy district, and the court’s main office is at the Frank E. Moss U.S. Courthouse, 350 South Main Street, Salt Lake City, UT 84101.

Utah is part of U.S. Trustee Region 19. The 341 meeting of creditors — a short Q&A with the trustee assigned to your case — is conducted by Zoom video conference for Chapter 7 and Chapter 13 cases filed on or after December 1, 2022. This is especially practical for St. George residents who would otherwise face a long drive to Salt Lake City. You receive a meeting ID and passcode with your court notice and attend from home. The trustee may approve telephone-only participation if video is not available to you.

Utah Homestead Exemption

Under Utah Code § 78B-5-503, Utah protects the equity in your primary residence through the homestead exemption. The Utah State Auditor publishes the adjusted amount by January 1 each year. For 2025, the primary-residence exemption was $52,400, adjusted for inflation from a 2019 statutory base. The figure changes annually — your attorney will confirm the current amount before you file.

Washington County’s housing market has seen significant appreciation, so understanding how much equity is protected — and how it interacts with your mortgage balance — is an important part of planning your bankruptcy. Both Chapter 7 and Chapter 13 can be structured to protect your home, depending on your equity level and current payment status.

Chapter 7 vs. Chapter 13 for St. George Residents

Chapter 7 discharges most unsecured debts — credit cards, medical bills, payday loans — through a court discharge. If your household income is at or below the Utah median (or passes the means test), you may qualify. A typical Chapter 7 case closes in four to five months.

Chapter 13 is a court-supervised repayment plan that lasts three to five years. It works well for homeowners who are behind on their mortgage (preventing foreclosure), people with incomes above the means test limit, and anyone with debts that Chapter 7 cannot discharge, such as priority tax debt or restitution obligations.

Frequently Asked Questions

Does Lincoln Law have an office in St. George?

No. We serve St. George and Washington County by virtual consultation (video or phone). Most clients complete their entire case without visiting an office. If you need to deliver documents, our Orem office accepts them by appointment.

I am retired and on a fixed income. Does that affect whether I qualify for Chapter 7?

It often helps. The means test compares your household income to the Utah state median. Retirees on Social Security — which is not counted as income for means-test purposes — frequently qualify for Chapter 7 without difficulty.

What happens to property I own in St. George if I file for bankruptcy?

Property you own becomes part of your bankruptcy estate, but exemptions protect what the law allows you to keep. Utah's homestead exemption, vehicle exemption, and other protections can shield significant assets. Your attorney will review your specific situation.

Can filing for bankruptcy stop a foreclosure on my St. George home?

Filing for bankruptcy triggers an automatic stay, which temporarily halts most collection actions, including foreclosure proceedings. Chapter 13 additionally lets you cure mortgage arrears over the life of the plan, potentially saving your home long-term.
