Debt in Fremont and the Tri-City Area

Fremont, Newark, and Union City sit at the intersection of Alameda County and the South Bay, with a workforce that spans manufacturing, technology, and essential services. High housing costs — among the highest in the country — can translate quickly into unmanageable debt when income drops or expenses spike. Medical costs, layoffs, and high-interest credit card balances are the three most common reasons Fremont residents contact us.

Bankruptcy is a federal legal protection available to anyone who qualifies, regardless of why the debt accumulated. Our attorneys will tell you plainly whether it is the right path for you.

Where Your Case Is Filed

Fremont is in Alameda County, which falls within the United States Bankruptcy Court for the Northern District of California, Oakland Division. The Oakland courthouse is at 1300 Clay Street, Oakland, CA 94612. Cases venued in the Oakland Division are randomly assigned among the judges in that division.

The Northern District falls under U.S. Trustee Region 17. The 341 meeting of creditors is held by Zoom video conference for Chapter 7 and Chapter 13 cases filed on or after May 1, 2024. You attend from your phone, tablet, or computer using a meeting ID provided in your court notice. Audio-only attendance is available if video is not accessible to you.

California Homestead Exemption — Alameda County

California’s homestead exemption is established by California Code of Civil Procedure § 704.730, which sets the exemption at the greater of: (1) the prior calendar year’s median single-family home sale price in the county, or (2) a statutory floor ($361,076 for 2025), capped at a ceiling ($722,507 for 2025). Both amounts adjust annually for inflation.

Alameda County’s median home prices — including those in Fremont — substantially exceed the current cap. The effective homestead exemption for most Fremont homeowners is therefore $722,507 for 2025, adjusted each year. This means a large amount of home equity is protected in bankruptcy. The precise figure changes annually; your attorney will confirm the current amount before filing.

High home equity does not automatically prevent you from filing Chapter 7 — but it does require careful analysis to ensure the equity is within the exemption before proceeding.

Chapter 7 vs. Chapter 13 in Fremont

Chapter 7 discharges most unsecured debts through a court discharge. It is well suited for individuals whose income falls below the California means test threshold. Unsecured debts — credit cards, medical bills, personal loans — are typically eliminated in full. A standard case closes within four to six months.

Chapter 13 creates a structured repayment plan lasting three to five years. It is often preferred by homeowners who are behind on mortgage payments (the plan lets you cure arrears), by individuals whose income is above the means test limit, and by anyone managing non-dischargeable debts like recent income taxes.

Frequently Asked Questions

Does Lincoln Law have an office in Fremont?

We do not have an office in Fremont. We serve Fremont and Alameda County through virtual consultation. Our Hayward office is approximately seven miles away and is available for document drop-off by appointment.

I work in manufacturing in Fremont and my hours were cut. Can I still qualify for bankruptcy?

Reduced hours lower your income, which often makes it easier — not harder — to qualify for Chapter 7. The means test is based on your average monthly income over the six months before you file. Your attorney will calculate whether you qualify.

Will the bankruptcy trustee take my car in Fremont?

California allows you to choose between two sets of exemptions. Under one set, a vehicle exemption protects up to $3,625 in equity (as of 2025, adjusted periodically). If your car equity is within the exemption and you keep up with payments, you can generally keep the vehicle. Your attorney will identify which exemption set is more favorable for your situation.

What happens to my BART or Caltrain commuter pass if I file?

Transit passes are not property subject to bankruptcy — they are services, not assets. Your transportation is unaffected by filing.
